General Terms and Conditions of Sale – Ateliers LYN

Article 1 – Scope of Application

These general terms and conditions of sale (hereinafter referred to as the “General Conditions”) apply without restriction or reservation to all sales concluded between the company Ateliers LYN, the seller on the one hand, SARL with a capital of 10,000 dirhams, registered under the Trade Register number 151725, and any user (hereinafter referred to as the “Customer”) of the website www.lynhomeharmony.com (hereinafter referred to as the “Site”) wishing to make a purchase. These General Conditions of Sale are accessible at any time on the Site and shall prevail, if necessary, over any other version or any other contradictory document. These general terms and conditions of sale may be subject to modifications. Ateliers LYN reserves the possibility to modify its general terms and conditions of sale at any time without prior notice to the Customer.

Article 2 – Object

The Site enables “Ateliers LYN” to offer for sale crafts items, decorations and accessories, and furniture and all items designated and created by and for Ateliers LYN. To make a purchase, the Customer must:

Have the capacity to enter into this contract, meaning to have reached the legal age of majority and not to be under guardianship or curatorship.

Not make purchases for the purpose of resale.

Article 3 – Products

The products offered for sale by Ateliers LYN are those displayed on the website at the time of consultation and subject to availability. In case of unavailability of a product, the buyer will be informed as soon as possible. The photographs and texts illustrating the products are not contractual. The Seller offers handmade items, which may result in variations in shades, shapes, finishes, and discoloration due to their artisanal nature “hand made”.

Article 4 – Prices

Prices are indicated in dirhams or euros depending on the delivery country requested by the Customer, including VAT, and excluding delivery charges. The prices indicated include the VAT applicable on the day of the order. However, Ateliers LYN reserves the right to modify its prices at any time. Delivery charges are the responsibility of the customer and are specified before order validation. In case of delivery outside Morocco, taxes and customs duties may apply.

Article 5 – Order Procedure and Terms

5.1 – Customer Identification. The Customer must log in to the Site to place an order. For their first order, the Customer has the choice between registration or direct order without registration. The Customer is responsible for their username and password.

5.2 – Placing the Order: The order process takes place in 4 steps. The Customer checks the contents of their shopping cart, chooses the delivery method, selects the payment method, and validates the payment. The Customer can pay either by credit card via Payzone or by bank transfer. Payment by bank transfer is available only in the territory of the Kingdom of Morocco.

Article 6 – Protection of Personal Data

Ateliers LYN undertakes not to disclose personal data or payment-related information to third parties, except as defined in the general conditions. Users have the right to access and modify their information.

Article 7 – Intellectual Property

All elements of the Ateliers LYN website are protected by copyright, trademarks, or patents. Any link to the site must be subject to prior authorization from Ateliers LYN.

Article 8 – Liability, Force Majeure, and Legal Provisions

Ateliers LYN has only an obligation of means. Ateliers LYN’s liability cannot be engaged for inconveniences related to the use of the Internet. In case of force majeure, the parties shall consult each other. In case of dispute, the Commercial Court of Casablanca is competent.
